PRIVACY POLICY

We take your privacy very seriously. Please read this privacy policy carefully as it contains important information on who we are and our information practices, meaning how and why we collect, use, disclose, sell, share, store, and retain your personal information. It also explains your rights in relation to your personal information and how to contact Gigaplex, DPO or supervisory authorities in the event you have a complaint or request. We collect, use, and are responsible for certain personal information about you. For California consumers, we are subject to the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA), Illinois Privacy Act of 2006, Florida Data Privacy Law of 2024. We may be responsible as a “controller” or a “processor”, depending on the circumstances, of that personal information. We are responsible for your personal information that we possessor or control as a “business” under the CCPA/CPRA.

Sensitive Personal Information Personal information is limited to account information of Gigaplex Academy’s customers which includes name, phone number(s), email address of a student, behavior and personality analysis, students aspiration and goals of success in life, including Gigaplex Academy’s proprietary data analysis. Gigaplex does NOT collect sensitive personal information revealing a consumer’s social security number, driver’s license and passport numbers, account numbers and credentials, precise geolocation, racial or ethnic origin, religious beliefs, or union membership, personal information concerning a consumer’s health, sex life, or sexual orientation, contents of a consumer’s mail, email and text messages where the business is not the intended recipient, genetic data, biometric information, or citizenship and immigration status.
Biometric Information We DO NOT collect information related to an individual’s physiological, biological, or behavioral characteristics, including information pertaining to an individual’s deoxyribonucleic acid (DNA), that could be used or is intended to be used singly or in combination with each other or with other identifying data, to establish individual identity. Biometric information includes, but is not limited to, imagery of the iris, retina, fingerprint, face, hand, palm, vein patterns, and voice recordings, from which an identifier template, such as a faceprint, a minutiae template, or a voiceprint, can be extracted, and keystroke patterns or rhythms, gait patterns or rhythms, and sleep, health, or exercise data that contain identifying information.

 

  1. Personal Information We Collect About You. We may collect and use the following personal information, that identifies, relates to, describes, is reasonable capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular student and subscriber of the Gigaplex Academy’s services: :
  • Student name and email address shared for purposes of online educational services;
  • Student phone numbers;
  • Student State of residence and domicile;
  • Behavior based on personality analysis and training;
  • Information related to students passions, interests, skills, dreams about ideal preferred employment; 
  • Personal Information collected is used for Gigaplex Academy Online Service, including to provide student technical support and for further development and improvement of Gigaplex Academy services; 
  • Information is shared in relation to Sponsoring Organization Services;
  • Student information is shared with Gigaplex Academy’s coaches, teachers, school and other sponsoring organizations (with students consent with regard to sponsorship, including grades and related progress;
  • Survey data and processed report data, and email data collected is stored and used  for further development of online services of Gigaplex Academy.

The following information is NOT collected: security number, physical characteristics or description, driver’s license or state identification card number, insurance policy number, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information Areas of interest for Gigaplex custom training for online courses with students; behavioral  and related analytics; phone number, mobile numbers and information related to  student passions, interest, skills and about students ideal preferred employment.

If you do not provide all the above personally identified information required for Our services to you, it may delay or prevent us from providing our services to you. 

  1. How Your Personal Information is Collected. We collect personal information from the following categories of sources:
  • You, directly in person, by telephone, text, or email and addresses and while signing up for the Gigaplex online course:
  • Advertising networks;
  • Acquired a list for direct mail marketing and email marketing;
  • Our IT and security systems, including: Automated monitoring of our websites and other technical systems, such as our computer networks and connections, communications systems, email, and instant messaging systems –and third party contracted website maintenance company backup data on a cloud offering–

  • Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (FERPA); and
  • Information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, his or her name, personal address, personal telephone number, personal email address, education; 
  • Information related to identity blueprint using behavioral and aspirational data used to make suggestions about  student projects, and what they are passionate about, student information related to analytics, including future goals and objectives of a student; 
  • Inferences drawn from any of the information identified above to create a profile about a student reflecting the student preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, aptitudes and Gigaplex student progress and related records
  1. Categories of Personal Information We Disclosed for a Business Purpose, unless You do not grant consent. In the preceding 12 months, we have or may have disclosed the following categories of personal information for a business purpose:

These Terms of Use shall be construed in accordance with and governed by law of Untied States and State of Georgia You hereby irrevocably consent to the laws where the disputes arising out of or related to the use of the Site or Service takes places 16(b). Mediation/ Arbitration/ Litigation. All disputes between the parties will he mediated to the fullest extent unless litigation form an essential parts of the claim which needs to be adjudicated and the dispute cannot be resolved through Mediation first and then an arbitration process.

GOVERNING LAW, JURISDICTION

 

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any principles of conflicts of law.   •  How Information Is Used and Shared
  • Gigaplex Academy Online Services and Support. We may use your Personal Information to provide the Gigaplex Academy Online Service, including user support, to you and your school or Sponsoring Organization as well as to improve Gigaplex Academy Online Services. Gigaplex Academy Communications. We may share with your coach, teacher, school and Sponsoring Organization information about student grades, progress or usage, including but not limited to, student activity scores, student course grades, student progress and utilization by students or teachers of the Gigaplex Academy Websites. Contact Information. Your contact information may be shared with your teacher, school and Sponsoring Organization. If you enroll in one of the Gigaplex Academy Online Service offerings where the instruction for that offering is provided by an Gigaplex Academy Online Instructor, your name, email address, school, phone number and state of residence will be shared with your online teacher. Your name and email address will be shared with other students participating in the same section of your Gigaplex Academy Online Service.
  •  Legal Requirements. Gigaplex Academy may disclose your Personal Information if we have a good faith belief that it is necessary in order to: (1) comply with any applicable federal, state or local law or regulation, including to comply with any subpoena, warrant, court order, or other legal process to which Gigaplex Academy is subject; (2) protect and defend the rights or property of My Online Academy; (3) protect the personal safety of you, other users of Gigaplex Academy Online Services or the public; or (4) to ensure compliance with our Terms of Use for the Gigaplex Academy Website. Civil Code Section 1798.83

Verifying Requests

 

If we receive any request we will use a two-step process for online requests where the California consumer must first, clearly submit the request and then second, separately confirm the request. We will use other appropriate measures to verify requests received by mail or telephone.

 

In submitting a request, a California consumer must provide sufficient information to identify the consumer, such as name, e-mail address, home or work address, or other such information that is on record with us so that we can match such information to the Personal Information that we maintain.
